Introduction

Welcome to Charm Optical ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website at charmoptical.ca, our online booking platform at see.charmoptical.ca, and all related services, including in-store purchases, eye examinations, and optical products (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

About Charm Optical

Charm Optical is a licensed optical dispensary and eye care provider located at 5035 Ellerslie Road SW, Edmonton, Alberta T6X 1X2, Canada. We are registered and operate in compliance with the laws of the Province of Alberta and the regulations of the Alberta College of Optometrists and the College of Opticians of Alberta.

Eligibility

You must be at least 18 years of age to use our Services independently. Minors under 18 may use our Services with the consent and supervision of a parent or legal guardian. By using our Services, you represent that you meet these requirements.

Services Offered

  • Comprehensive eye examinations performed by licensed optometrists
  • Prescription eyewear including glasses, sunglasses, and contact lenses
  • Lens services including blue-cut lenses, progressive lenses, and same-day single vision lenses
  • Online appointment booking through our scheduling platform
  • Insurance benefit assistance for eligible plans

All eye examinations are conducted by independently practising optometrists in accordance with Alberta health regulations. Charm Optical does not provide medical diagnoses or treatment beyond the scope of optometric practice.

Online Booking & Appointments

When you book an appointment through our platform:

  • You agree to provide accurate personal and contact information.
  • Appointment confirmations are sent via email and/or SMS to the contact information you provide.
  • We reserve the right to cancel or reschedule appointments due to unforeseen circumstances, with reasonable notice.
  • Patients who arrive more than 15 minutes late may need to reschedule.
  • We request at least 24 hours' notice for cancellations or rescheduling.

Pricing & Payment

  • All prices displayed on our website are in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated.
  • Prices for prescription eyewear may vary based on lens type, coatings, and frame selection.
  • We accept major credit cards, debit, and direct insurance billing where available.
  • A deposit may be required for custom or special-order items.
  • Eye examination fees are set by the attending optometrist and may vary. Alberta Health Care covers annual eye exams for children under 19 and adults 65 and over.

Insurance & Benefits

We assist patients in submitting claims to eligible insurance providers. Accepted providers include Alberta Blue Cross, Canada Life, Manulife, Desjardins, Great-West Life, AISH, Alberta Works, and others. Please verify your coverage details with your insurer before your appointment. Charm Optical is not responsible for denied claims or discrepancies in benefit coverage.

Product Warranties

  • Frames: Manufacturer warranties vary by brand, typically covering defects in materials and workmanship for one year from purchase.
  • Lenses: Prescription lenses include a satisfaction adjustment period. See our Refund & Return Policy for details.
  • Contact lenses: Unopened, undamaged contact lenses may be exchanged within 90 days if the prescription changes.

Warranties do not cover damage caused by misuse, accidental breakage, normal wear, or unauthorized repairs.

Intellectual Property

All content on our website -- including text, images, logos, graphics, and design -- is the property of Charm Optical or its licensors and is protected under Canadian copyright and trademark law. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with Alberta's Personal Information Protection Act (PIPA) and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

Health Information

Patient health information collected during eye examinations is maintained by the attending optometrist in accordance with the Health Information Act (HIA) of Alberta. This information is kept strictly confidential and is only shared as required for your care or as permitted by law.

Limitation of Liability

To the maximum extent permitted by law:

  • Charm Optical shall not be liable for indirect, incidental, or consequential damages arising from your use of our Services.
  • Our total liability for any claim related to our Services shall not exceed the amount you paid for the specific product or service giving rise to the claim.
  • We do not guarantee that our website will be available at all times or free from errors.

Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall be governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Edmonton, Alberta.

Before pursuing formal legal action, we encourage you to contact us directly to resolve any concerns.
